Will an artist's submitted work ever be used to train an AI? |
No. ARwall is a company founded by artists for artists, and it is our pledge not to use an artist's work to train an AI model without their agreement and consent. This is how your scenes will be used by our end-users as shown in the following YouTube videos.
Terms and Conditions
By submitting your artwork, you agree to the following terms and conditions:
- No Obligation: Submission of your artwork does not obligate us to use, display, or distribute your 3D scene on our marketplace.
- Release of Liability: You acknowledge and agree that our marketplace may feature 3D scenes similar to or identical to your submission. We are not liable for any similarities or identical aspects between your submission and other 3D environments available on our marketplace, regardless of the source.
- Intellectual Property Rights: By submitting your artwork, you represent and warrant that you are the owner of all intellectual property rights in the submitted 3D scene or have obtained all necessary rights and permissions from the rightful owner to submit the artwork for commercialization.
- Non-Exclusive License: By submitting your 3D scene, you grant us a non-exclusive, royalty-free, worldwide license to review and evaluate your submission. This license does not grant us the right to use, distribute, or display your 3D environment beyond the purposes of review and evaluation.
- Confidentiality: While we will make reasonable efforts to maintain the confidentiality of your submission, we cannot guarantee absolute confidentiality. You should not submit any confidential or proprietary information that you do not wish to be disclosed.
- Indemnification: By submitting your 3D scenes or other assets to the ARFX App Marketplace, you acknowledge and agree that ARwall shall not be responsible or liable for any claims, damages, or liabilities arising from the use, distribution, or commercialization of your submissions. As the creator, you are solely responsible for ensuring that your submissions do not infringe on the intellectual property rights of others and that you have obtained all necessary permissions for their use. You agree to indemnify and hold ARwall harmless from any and all claims, costs, and expenses, including legal fees, related to any breach of these representations and warranties.
GLOSSARY
- Artwork: Any materials which the submitting artist is the creator and owner of.
- 3D scene: A 3D project file and its associated content that can be run by a 3D engine and compiled into a Scenepack, currently limited to Unreal Engine 5.4 or later.
- Marketplace: A gallery of digital products, including Scenepacks, that contains features to discover, preview, and manage the purchase or subscription to such digital products.
- Scenepack: A compiled executable 3D scene containing some ARFX software, that can be run without 3D engine source code.
- 3D engine: An application for developing 3D assets and experiences, such as Unreal Engine 5.x.
